Terms of Use

Effective Date: April 7, 2026
These Terms of Use (“Terms”) govern your access to and use of the services provided by Phonetico (“Phonetico”, “we”, “our”, or “us”), including our VoIP communication platform and related features (the “Services”).

By creating an account or using our Services, you agree to these Terms.

1. Services

Phonetico provides business communication services, including but not limited to:

  • Voice over IP (VoIP) calling
  • SMS messaging
  • Voicemail and voicemail-to-email
  • Call recording
  • Additional communication features

Services are billed on a per-seat monthly basis unless otherwise agreed.

2. Account Registration

You agree to:

  • Provide accurate and complete information
  • Keep your account credentials secure
  • Be responsible for all activity under your account

You are responsible for ensuring that all users under your account comply with these Terms.

3. Billing & Payment

  • Services are billed monthly per active seat
  • Payment is due upon invoice issuance
  • A 7-day grace period applies to overdue payments
  • We may suspend Services after the grace period
  • Accounts may be terminated after 30 days of non-payment

All fees are non-refundable, including partial billing periods.

4. Cancellation

  • You may cancel your Services at any time
  • Cancellation takes effect at the end of the current billing cycle
  • No refunds will be issued for unused time

5. Acceptable Use

You agree NOT to use the Services for:

  • Illegal activities
  • Fraud, scams, or deceptive practices
  • Spam, robocalling, or harassment
  • Any misuse of telecommunications networks

We reserve the right to suspend or terminate accounts immediately for violations.

6. Third-Party Services

Phonetico relies on third-party providers (including telecommunications carriers and infrastructure providers) to deliver the Services.

We are not responsible for failures, delays, or limitations caused by third-party services.

7. Service Availability

We strive to provide reliable service with a target uptime of 99%, but:

  • Services are provided “as is” and “as available”
  • We do not guarantee uninterrupted or error-free operation
  • Temporary outages, maintenance, or disruptions may occur

8. Emergency Services (911 / E911)

Phonetico provides access to emergency services; however:

  • VoIP-based 911 services may differ from traditional landline services
  • Location information may not always be accurate
  • Service may be unavailable during power outages or internet disruptions

You are responsible for informing all users of these limitations.

9. Limitation of Liability

To the fullest extent permitted by law:

Phonetico shall not be liable for:

  • Missed calls
  • Lost business or revenue
  • Service interruptions
  • Data loss
  • Indirect or consequential damages

10. Data & Privacy

  • All data is stored in Canada
  • We handle data in accordance with applicable privacy laws, including PIPEDA
  • Customers retain control over their data, including deletion where applicable

11. Suspension & Termination

We may suspend or terminate your account if:

  • You fail to pay fees
  • You violate these Terms
  • Your use poses risk to our network or other users

We may terminate accounts after 6 months of inactivity.

12. Modifications

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Province of Quebec and the laws of Canada applicable therein.
